Welcome to the “User Agreement” for Boot Fair Online Ltd. Boot Fair Online “we, us, our” is situated in Walmer, Kent, England and offers a service to browsers, sellers and buyers.
You are asked to read the terms and conditions written in this agreement and if you do not agree with what has been written you must not use this site.
Information
1 Boot Fair Online Ltd is purely an advertising business and will take no part in the transaction between the buyer and the seller. We are not accountable, responsible or liable for any part of the private transaction process between both the buyer and the seller. Persons under the age of eighteen must only access the site under supervision of a parent or guardian. If you are under eighteen years of age and cannot comply with the above statement you must not use this site.
1a. User details and information sent to this site will not be disclosed to any parties unless the user chooses to and makes the information available to Boot Fair Online Ltd.
You are totally and utterly accountable for the information you supply and send us at Boot Fair Online Ltd. We act merely as a portal for your information and accept no responsibility what so ever for any information offered by you. You agree information supplied by you to Boot Fair Online Ltd must not be…misleading, false, exaggerated, abusive, frightening, demeaning or inaccurate.
1b. Boot Fair Online takes all information seriously and respects the right to privacy. All information compiled by us will be in compliance with the Data Protection Act 1998 (2000)
1c. Boot Fair Online Ltd accepts information regarding user contact details in good faith, however, because it is difficult to verify and monitor this information Boot Fair Online Ltd, accepts no responsibility to the validity and quality of this information entered onto this site.
1d. Whilst Boot Fair Online Ltd will take responsibility to compile and add data to the site as listed we will take no responsibility for any false information added to the site by us believed to be true. If you use this site you agree that Boot Fair Online Ltd is not responsible for the accuracy of any information accepted in good faith by us to be true.
You must not disclose any information gained from using this site to any others without permission from the person or persons to whom the information relates to. Information for Buyers, Browsers Sellers
2. Boot Fair Online Ltd claims no responsibility to the information provided relating to the credibility of the browser, seller or buyer. As a seller you must ensure you have the right or consent to sell and as a buyer that you have the right to buy. Browsers must not use any information gained from the site without consent of the “user” involved to which could lead to an invasion of privacy. Sellers must describe the item truthfully and not mislead the potential buyer by falsifying the information listed on the booking form. If the buyer has reason to believe the seller has mislead them Boot Fair Online Ltd will not accept any liability or responsibility … this is an issue to be discussed between the buyer and seller. Boot Fair Online Ltd has no responsibility to what is viewed by us as a private transaction between both buyer and seller. We are an advertising agency selling “Car Boot Pitches” on line and will not accept any pursuing action resulting from a disagreement between buyer and seller of an item bought or sold. Remember, the onus is on you the user to apply common sense when entering into any transaction. There are unscrupulous people who will masquerade as being honest and truthful when in fact they are just the opposite. There may also be people underage using this site. Please remember you are accepting these risks as a user of Boot Fair Online Ltd and we cannot accept responsibility for people acting under false pretences and who choose not to comply with Boot Fair Online Ltd terms and conditions.
Boot Fair Online will not research information given to them on the booking form and at all times it remains the responsibility of the buyer to ensure that before they purchase an item from the seller they have read the information correctly and if in any doubt about the description of the item check out the information with the seller before making the purchase. Boot Fair Online Ltd cannot accept any responsibility for the quality, condition, safety, legality or the value of the items and photographs offered for sale on this site. The user should not make any assumptions based on the written description or any accompanying photograph of the item for sale or its worth. You agree with Boot Fair Online Ltd when we say we will not accept any obligation or responsibility to any transaction occurring between a buyer and seller based on information provided against any item offered for sale. You also agree it is the responsibility of both the buyer and the seller to arrange for any transaction to take place including viewing, method of payment and delivery or collection of goods bought and sold. Boot Fair Online Ltd acts purely as a means of advertising the item for sale and this is where their responsibility ends.
2a.Unacceptable Items
Boot Fair Online Ltd states categorically that we will not accept any items for sale which do not comply with the information on the site under “How to Sell”. We do not accept any responsibility to protect you from any items offered for sale and you should not make any assumptions that descriptions of goods are accurate and safe for use by both people and property.
2b. Boot Fair Online Ltd accepts no accountability or responsibility in the event that you have any right, action or claim against any other user of the site. You agree to follow any right, action or claim independently without the involvement of Boot Fair Online Ltd. Boot Fair Online Ltd is released from any pursuing action and any claims, costs, damages, losses, expenses and legal fees, both known and unknown, in the case of a situation involving this site.
2c Boot Fair Online Ltd can terminate any contract between a seller if they have any concerns or reservations over items offered for sale on the site. Monies will not be refunded if the transaction has already been previously accepted and entered onto the site in good faith. Boot Fair Online Ltd accept only items for sale which are in compliance with the information written on the sellers information guide “ How to Sell” Boot Fair Online Ltd accept the right to refuse any item offered for sale. Items offered for sale must comply within the law. All goods offered for sale on this site must be legal and placed for sale in good faith. Boot Fair Online Ltd aims to trade in compliance with all relevant legal documentation and policies relating to “Distant Selling”. It reserves the right to edit, or delete any user or item who is fraudulent and dishonest in their intentions and is not complying or has not complied with Boot Fair Online Ltdterms and conditions. Any decision taken by Boot Fair Online Ltd to refuse or accept a user or item to prevent misuse of the site is final. Boot Fair Online Ltd will comply with all aspects of English law.

On receipt of payment Boot Fair Online Ltd will confirm booking and if accepted enter details onto the site within 24hrs. You acknowledge we will begin selling your items in accordance with the Distance Selling Regulations 2000.
The service we provide begins within 7 days of payment (your advertisements are usually activated within 24 hours). You agree to this 'early delivery' of service and as such waive your right to your normal 7 day 'right to cancel' and any refund.
We reserve the right to change the terms and conditions when and where appropriate in the interest of the site.

Boot Fair Online Ltd cannot always guarantee uninterrupted access to our site due to circumstances out of our control however; we will endeavour to maintain this site, so far as reasonably practicable, competently, safely and securely whilst adhering to both guidelines and terms and conditions written for Boot Fair Online Ltd.
